Australia’s largest brain research center, The Florey Institute of Neuroscience and Mental Health, has initiated legal action against one of its executives, James Tran, alleging he illicitly deleted and stole a significant amount of sensitive information. The alleged incident reportedly took place during a late-night operation at the institute’s Melbourne laboratory.
The lawsuit, filed in the Supreme Court of Victoria, accuses Tran, who was serving as the business development manager, of erasing documents after allegedly downloading thousands of pages of advanced research. The Florey claims these actions occurred while Tran was also the chief executive of Centron Bio, a spin-out company focused on raising funds for further medical research.
Allegations of Theft and Unauthorized Access
According to the court documents, the alleged thefts occurred in late October. The Florey contends that Tran downloaded nearly 5,000 files and folders, including confidential documents related to the work of Dr. Fazel Shabanpoor, a prominent researcher at the institute. The files reportedly contained information on Centron Bio’s innovative methods for delivering medicines to the brain, aimed at treating conditions such as Alzheimer’s, Parkinson’s, and motor neurone disease (MND).
The institute is seeking a court order to compel Tran to destroy the information and prevent him from using or sharing it. Additionally, The Florey demands that Tran disclose the identities of any individuals with whom he may have shared the information.
“The Florey neither authorised nor required Dr Tran in his employment to download and save to an external USB drive the documents,” court documents stated. “The Florey reasonably fears that Dr Tran intends to keep for himself and then use The Florey confidential information to obtain an advantage to himself, obtain an advantage for a third party and/or to cause detriment to The Florey.”
Midnight Laboratory Incursion
The legal claim further alleges that Tran, accompanied by an associate, accessed the Melbourne laboratory under the cover of darkness to delete various documents, including commercial agreements and market analysis. The institute asserts that this action was unauthorized and part of a deliberate attempt to undermine its operations.
A spokesperson for The Florey declined to comment on the ongoing legal proceedings. However, the court documents reveal that in late November, the institute reached out to Tran’s legal representatives, demanding the return of the confidential information. These requests were reportedly ignored.
